From the combined provisions of legal regulations, a fundamental principle clearly emerges: projects and systems must be designed and built according to the state of the art.

Compliance with the state of the art is therefore the sole mandatory requirement that must be met for any type of project or system.

Regarding the relationship between the state of the art and technical standards, legislation and case law have clearly established—without ambiguity—that:

• the state of the art is mandatory (see not only the Civil Code but also Ministerial Decree 37/08);
• technical standards are voluntary (see Directive 98/34/EC);
• an Italian, European, or harmonized EU technical standard, when referenced by law, may constitute presumption of conformity with the state of the art, provided that the applicable legislation is fully respected and that the standard is relevant to the specific system in question.
